Privacy Policy

Asklemedica (Japanese name: Asklemedica, hereafter referred to as “Am”) has established the following privacy policy (hereafter referred to as “this policy”) regarding the handling of personal information of Advisors in the services provided (hereafter referred to as “this service”).

Article 1 (Compliance with Laws and Regulations)

Am complies with the Act on the Protection of Personal Information, the provisions of the Telecommunications Business Act, and other related laws and regulations concerning the secrecy of communications, guidelines concerning the protection of personal information in the telecommunications business (hereinafter referred to as “Guidelines”), and this Privacy Policy in the acquisition, use, and all other handling of personal information of the Advisor.

Article 2 (Protection of Rights and Interests of Service Users)

Upon request from an individual, Am will stop sending direct mailings, stop encouraging telephone calls, and take other measures.

Article 3 (Personal Information)

”Personal information” refers to “personal information” as defined in the Personal Information Protection Law, which includes information about a living individual that can identify a specific individual, such as name, date of birth, gender, address, telephone number, contact information, occupation, and other descriptions contained in the information. This also includes information that can identify a specific individual from that information alone (personal identification code), such as data related to appearance, fingerprints, voice prints, and health insurance card insurer numbers.

Article 4 (Purpose of Collecting and Using Personal Information)

When acquiring and using personal information, Am will clarify the purpose of use and will use personal information within the scope of the following purposes, except where the consent of the individual has been obtained in advance or where exceptions are permitted under the Act on the Protection of Personal Information or other laws and regulations.

(a) To provide Am’s Services (this purpose includes providing clients with information that does not reveal the Advisor’s name,
   contact information, or place of employment)
(b) Contacting and providing information on Advisor requests and coordination with clients
(c) Transfer of the Advisor remuneration
(d) Provision of information, operation and management related to Ams business, and enhancement of services
(e) To investigate and analyze the usage of the Service
(f) To innovate and improve user satisfaction with the content of our service or develop new services
(g) To distribute or display Am or third-party advertisements
(h) To contact you as necessary for maintenance, important notices, etc.
(i) To resolve problems in the operation of this service

Article 5 (Change of Purpose of Use)

  • Am shall change the purpose of use of personal information only when it is reasonably considered that the purpose of use is related to the purpose before the change.
  • When the purpose of use is changed, the changed purpose will be announced on the Am website or notified to the Advisor by the method prescribed by Am.

Article 6 (Method of Collecting Personal Information)

Am will not acquire personal information through deception or other wrongful means.

  • Information that Am obtains from its Advisors: When an Advisor registers for use, Am may ask for personal information such as name, date of birth, gender, occupation, place of employment, telephone number, e-mail address, bank account number, and information regarding identity verification. In addition, information regarding the personal information of the Advisors may be collected from publicly available information sources, such as those between Advisors and business partners.
  • Information that Am obtains in connection with the use of the Services: Regardless of whether or not it falls under the category of personal information, the following information regarding the use of the Service will be acquired: Information related to the content of the Services used by the Advisor, the date, time, and number of times the Advisor uses the Services, information related to the use and viewing of the Services (This includes cookie information, access logs, and other information regarding usage conditions, the terminal used, location information, IP addresses, browser information, information regarding the Advisor’s communications including browser language, etc.)

Article 7 (Security Control Measures)

Am makes every effort to keep the Advisors’ personal information accurate and up-to-date and takes necessary and appropriate security control measures to protect it from unauthorized access, falsification, leakage, loss, and damage.

Article 8 (Management of Employees)

Am supervises its employees in a necessary and appropriate manner to ensure the safe management of personal information of Advisors. Additionally, Am provides its employees with education and training necessary to ensure the appropriate handling of personal information.

Article 9 (Outsourced Operations)

Am may outsource all or part of the handling of personal information within the scope of the purpose of use in the business of this service and the business associated with this service (recruiting, scheduling, moderation, translation, interpretation, transcription, etc.). In this case, Am will select a company that is recognized to handle personal information appropriately, will properly stipulate in the consignment contract the safety control, confidentiality, conditions for re-consignment, and other items related to the handling of personal information, and will carry out necessary and appropriate supervision.

Article 10 (Provision of Personal Information to Third-Parties)

(a) When it is necessary for the protection of the life, body, or property of an individual and it is difficult to obtain the consent of the individual
(b) Cases in which the provision of personal information is particularly necessary for improving public health or promoting the sound growth of
   children, and in which it is difficult to obtain the consent of the person concerned
(c) When it is necessary to cooperate with a national agency, a local government, or an individual or entity entrusted by either a national agency
  or local government to execute affairs prescribed by law, and obtaining the consent of the individual is likely to impede the execution of such   affairs.

Article 11 (Response to Leakage, etc.)

In the event of a leakage, etc., of personal information of the Advisor, Am will take appropriate measures such as promptly notifying the Advisor of the facts.

Article 12 (Data Transfer of Acquired Information to Foreign Countries)

Am may provide acquired information to clients in foreign countries for the purposes specified in “Article 4 (Purpose of Collecting and Using Personal Information) a.” The recipient takes the measures required of the business operator in their own country for handling personal information according to the following regulations.

Article 13 (Retention Period of Personal Data)

All acquired personal information will be disposed of when it is deemed reasonably unnecessary in light of Am’s normal business operations. However, this does not apply to the following cases

  • When it is required to be preserved in accordance with the provisions of laws and regulations
  • With the consent of the person in question.

Article 14 (Disclosure of Personal Information)

  • When requested by an individual to disclose their personal information, Am will disclose such information to the individual without delay. However, Am may decide not to disclose all or part of the information if disclosure would result in any of the following cases, and if Am decides not to disclose the information, it will notify the individual to that effect without delay:
    (a) If there is a risk of harm to the life, body, property, or other rights or interests of the person concerned or a third-party
    (b) If there is a risk of significant hindrance to the proper conduct of Am’s business
    (c) In any other case that would violate laws and regulations
    (d) When the identity of the person making the request for disclosure cannot be verified
  • Notwithstanding the provisions of the preceding paragraph, in principle, Am will not disclose non-personal information, such as historical information and characteristic information.

Article 15 (Correction and Deletion of Personal Information)

  • Advisors may request Am to correct, add, or delete their personal information (hereafter referred to as ‘correction, etc.’) in accordance with the procedures set out by Am, if their personal information in Am’s possession is incorrect.
  • If Am receives a request from the Advisor under the preceding paragraph and determines that it is necessary to respond to the request, Am shall make corrections to the personal data concerned without delay.
  • If Am corrects the information in accordance with the preceding paragraph, or if Am decides not to correct the information, Am will notify the Advisor of this without delay.

Article 16 (Suspension of Use of Personal Information, etc.)

  • When Am is requested by an Advisor to stop or erase the use of personal information on the grounds that it has been handled beyond the scope of the purpose of use or that it has been obtained by wrongful means (hereinafter referred to as ‘stop of use’), Am will carry out the necessary investigation without delay.
  • If, based on the results of the investigation referred to in the preceding paragraph, it is deemed necessary to comply with the request, the use of the personal data in question will be discontinued without delay.
  • When Am has made a decision to cease use or not to cease use in accordance with the provisions of the preceding paragraph, it will notify the Advisor of this without delay.
  • Notwithstanding the preceding two paragraphs, if it is difficult to suspend the use of the Advisor, such as when there are significant costs involved in suspending the use of the Advisor, and if alternative measures necessary to protect the Advisor’s rights and interests can be taken, these alternative measures shall be taken.

Article 17 (Use of Cookies)

Cookies are pieces of identification information sent by the server to the website user’s browser and stored on the browser side for the efficient operation of the website. Cookies can be used to obtain information such as the history of pages visited, the date, time, and number of times the site has been visited, but they do not obtain personal information about the user. Users can manage or reject cookies by changing their browser settings at their own risk. However, if cookies are disabled or deleted, some functions of the website may be restricted.

The Am website uses cookies for the following purposes

To enhance your browsing experience
To compile and analyze the browsing history of the pages on the site
To use as statistical data for marketing and advertising activities

Article 18 (Use of Logs and Equipment Information)

  • Log: Am collects IP address, browser type, browser language, etc., which are automatically generated when an Advisor visits the homepage. This information is used to analyze the user’s environment, to provide better service, and to prevent illegal activities that may interfere with the normal provision of service. Records related to searches are stored and managed in a form that does not allow identification of individuals and are used to create statistical data and for other purposes.
  • Equipment Information: Am may collect device information such as individual identification information of terminals. This information is used to provide better service and to prevent illegal activities that may interfere with normal service provision.

Article 19 (Concerning Behavioral Targeting Advertisements)

  • Am uses the information collection module to collect, store, and use the following information when providing this service or affiliated services in order to implement targeted advertising (an advertising method that delivers advertisements according to the needs, interests, and concerns of customers) by Am or a third-party such as an ad-serving company:
    (a) Behavioral history information (i.e., information that can be used to analyze the customer’s needs, interests, and concerns by
       accumulating it, such as usage history of the Services, but which does not lead to the identification of a specific individual)
    (b) Terminal information
    (c) Location information
  • Am provides the information collected in accordance with the preceding paragraph to a business operator that distributes behavioral targeting advertisements (hereinafter referred to as ‘advertisement distributor’) for the purpose of delivering useful information to customers by distributing optimum advertisements customized to the needs, interests, and concerns of customers.
  • Am retains the action history information, etc., collected from customers only for a period of time that is legitimate and legitimately required for business purposes.
  • When Am provides action history information, etc., to advertising distributors, Am endeavors to take the following measures to prevent leakage, loss, or damage of such information and for other safety management:
    (a) Algorithms and other mechanisms for encrypting behavioral history information and other information shall not be disclosed.
    (b) Providing behavioral history information, etc., to advertising distributors on condition that it is used only within the scope of
      the purposes of use set out in paragraph 2.
    (c) If the advertising distributor further provides behavioral history information, etc., to other third-parties, the advertising distributor shall
      be obliged to provide such information to such third-parties under the same conditions as those in the preceding item.

Article 20 (Disclaimer: Links to other Websites)

Am’s website may contain links to websites operated by other parties for the convenience of our customers and to provide information. These websites may be independently operated and unaffiliated with Am. The linked sites may have their own privacy notices or policies, and we strongly recommend that you review the notices or policies when accessing the linked websites. Unless the linked website you are accessing is owned or controlled by Am, Am is not responsible for the content of the site, use of the site, or the privacy practices of the site.

Article 21 (Changes to Privacy Policy)

  • The contents of this Policy may be changed without notice to the Advisor, except as otherwise provided by law or otherwise in this Policy.
  • Unless otherwise specified by Am, the revised policy will be effective from the time it is displayed on the Am website or notified to the Advisors, and the Advisors will be deemed to have agreed to the revised policy by using this service after the revised policy takes effect. After the policy change takes effect, the Advisor will be deemed to have agreed to the revised policy when the Advisor uses the service.

Article 22 (Continuous Improvement)

Am will strive to continuously improve the handling of personal information within the company through the maintenance of internal regulations regarding the protection of personal information, employee education, and the implementation of internal audits.

Article 23 (Contact for Complaints and Other Inquiries)

Am will respond promptly and appropriately to complaints and other inquiries from the Advisors regarding the handling of personal information. Complaints, inquiries about this policy, and other inquiries should be directed to the following contact point:
